The Village of Bath Police Department arrested a Hornell man following a disturbance report at a local business.

On Monday, officers responded to the Kwik Fill on West Morris Street after receiving a report of a male smashing items inside a bathroom. Upon arrival, patrols located the individual inside the bathroom. Following an investigation, it was determined that 41-year-old Franklin Brockway was allegedly under the influence of drugs and in possession of a quantity of fentanyl.

Brockway was arrested and charged with Criminal Possession of a Controlled Substance in the Seventh Degree and Public Appearance Under the Influence of Drugs.

He was processed and released on an appearance ticket returnable to Bath Village Court at a later date.

The charges are accusations, and the defendant is presumed innocent unless and until proven guilty. Police reports are automatically removed from this site after 90 days.
