UPDATE: Driver Charged in I-390 Accident That Killed Roadside Worker

Just before 11 Tuesday night, State Police responded to reports of a three-vehicle crash on I-390 North near exit 4 in the town of Dansville.

A preliminary investigation determined that a disabled tractor-trailer, operated by 71-year-old Elias Noam, of Rochester, and an assisting utility vehicle were on the shoulder of I-390 north. Roadside responders from the utility vehicle were outside assisting the disabled tractor-trailer when another tractor-trailer, operated by 55-year-old Marwan Bisharat, of Ontario Canada, traveling northbound struck the side of the disabled tractor-trailer.

During the investigation, it was determined that two workers, 18-year-old Timothy Washburn, of Fillmore and 38-year-old Jason Marshall, of Portageville, NY, from the assisting utility vehicle, were standing outside of the disabled tractor-trailer and were struck. Marshall was pronounced dead at the scene and Washburn was injured and transported to Strong Memorial Hospital for treatment.

The involved tractor-trailer continued across the center median and came to rest in the southbound lane. Bisharat was charged with Vehicular manslaughter 2nd (D Felony), Driving While Ability Impaired by Drugs (Unclassified Misdemeanor), and traffic infractions.

The New York State Police Collision Reconstruction Unit responded to the scene.

A roadside worker was struck and killed on Interstate 390 in Dansville, just past the Steuben County line, late Tuesday night.

State Police said a disabled tractor-trailer and an assisting utility vehicle were on the shoulder just north of Exit 4 when another tractor-trailer traveling north struck the side of the disabled rig. The two roadside workers were also struck by the tractor-trailer with one of them, a 39-year-old man, being killed. The other man, an 18-year-old, was taken to Strong Memorial Hospital for treatment of undisclosed injuries.

The names of those involved have not been released.

Following the impact of the collision, the involved tractor-trailer continued across the median and came to rest in the southbound lane.

State Police are still investigating
