Montezuma Felon Arrested on Weapons Charge

A Montezuma man was arrested last Tuesday morning after probation officers discovered a firearm in his residence.

Cayuga County Sheriff Brian Schenck reports that deputies were dispatched to a home in the Town of Montezuma at approximately 11 a.m. on June 30th. Cayuga County Probation Officers conducting a home visit had located a rifle inside the residence of 36-year-old Andrew Smith.

The subsequent investigation established probable cause that Smith, who has prior felony convictions, was illegally in possession of the rifle while under the supervision of Cayuga County Probation. Smith was taken into custody and charged with Criminal Possession of a Weapon in the Fourth Degree.

Following his arrest, Smith was processed at Centralized Arraignment and sent to jail in lieu of bail.

The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
