An Auburn man has been found guilty of assaulting a police officer during an incident last July, the Cayuga County District Attorney’s Office announced.
According to DA Brittany Grome Antonacci, 54-year-old Chad McMillan was convicted on Thursday of Assault in the Second Degree, a violent felony, and DWI, Resisting Arrest, and Obstructing Governmental Administration, all misdemeanors, following a three-day jury trial presided over by Judge Jon Budelmann.
According to the DA’s office, Auburn Police officers attempted to arrest McmIllan on July 21, 2025, for driving while intoxicated. The office said McMillian “intentionally resisted arrest and, in the course of preventing an officer from performing a lawful duty, caused the officer to sustain a physical injury.” The officer suffered a severe laceration to his ear, requiring surgical reattachment, the office said.
When sentenced in August, McMillan faces a maximum sentence of seven years in prison followed by three years post-release supervision.

Law enforcement officers put themselves in harm’s way every day to protect our community. This verdict sends a clear message that individuals who choose to resist lawful police action and cause injury to an officer will be held fully accountable under the law,” said DA Antonacci.
