Two Town of Lyons men were arrested Tuesday on separate criminal trespass charges involving CSX railroad property, according to the Wayne County Sheriff’s Office.

Deputies arrested 52-year-old Zachary Levine of Franklin Street after responding to a report of a trespass in progress. Authorities say Levine was observed entering a designated and clearly posted no-trespass railroad zone belonging to CSX.

In a separate incident, deputies arrested 37-year-old Johnathan Tarver following an officer-initiated stop. Investigators say Tarver was seen crossing southbound on the CSX railroad tracks near 14 Franklin Street.

Both men were charged with Criminal Trespass in the Third Degree. They were transported to the Wayne County Sheriff’s Office for processing and later released on appearance tickets.

Levine and Tarver are each scheduled to appear in Lyons Town Court at a later date to answer the charges.

The charges are accusations, and the defendant is presumed innocent unless and until proven guilty. Police reports are automatically removed from this site after 90 days.
