Special Meeting Set on Penn Yan Lawsuit Settlement

The Penn Yan Village Board will hold a special meeting on Friday morning to consider a proposed settlement agreement that could resolve multiple lawsuits involving Champlin Avenue and property owned by local businessman Douglas Marchionda.

According to documents prepared for the meeting, the agreement would settle two cases currently pending in Yates County Supreme Court concerning the status of a roadway through Marchionda’s property and amendments to the village’s code regulating vehicles and auto repair businesses.

Under the proposed settlement, the village would repeal its 2024 resolution declaring portions of Champlin Avenue and a roadway through Marchionda’s property to be village streets. The agreement would also require the village to abandon any claims to a prescriptive roadway through the property and discontinue a portion of roadway currently listed on the village’s highway inventory.

The settlement further calls for revisions to Chapter 186 of the Village Code to restore an exception for New York State-licensed motor vehicle repair shops. The proposed changes would need approval from the Village Board.

In return, Marchionda would acknowledge a portion of Champlin Avenue as a village street and grant the village limited permission to turn around snowplows and perform certain maintenance activities near the end of the roadway.

If approved and finalized, the agreement would result in the dismissal with prejudice of both lawsuits pending between Marchionda and the village.

The special meeting is scheduled for 8 a.m. Friday.
