On Wednesday, an officer with the Village of Bath Police Department conducted a traffic stop on a vehicle traveling eastbound on West Washington Street for an alleged violation of the New York State Vehicle and Traffic Law.

Upon further investigation, the operator of the vehicle, identified as Charles Horton, of Hornell, was determined to be allegedly under the influence of alcohol and was subsequently placed under arrest.

Throughout the investigation, a passenger in the vehicle, Stacie Horton, of Hornell, allegedly refused to exit the vehicle upon the arrival of a tow truck called to impound the vehicle. Despite several opportunities to comply with officer commands, Stacie Horton continued to refuse to exit the vehicle. She was then escorted out of the vehicle, during which she allegedly physically resisted and was taken into custody.

Stacie Horton was charged with one count of Obstructing Governmental Administration in the Second Degree and Resisting Arrest, both Class A misdemeanors.

Both Charles Horton and Stacie Horton were processed and released on appearance tickets. They are scheduled to appear in Bath Village Court at a later date.

The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
