The second trial of a Seneca Falls man accused of killing his 3-year-old stepson, almost five years ago, is scheduled next month.
Donald Bovio faces several charges, including second-degree murder, for the May 2018 death of his stepson Peter.
Bovio pleaded guilty the following year and was sentenced to 15 years to life in prison, but an appeals court vacated the conviction last year.
The Finger Lakes Times reports after pleading guilty, Bovio later professed his innocence and twice tried to withdraw his plea.
