A Canandaigua man who pled guilty to possessing child pornography has been caught again.
According to the US Attorney’s Office, Preston Herbst was serving a probation sentence in January of 2022 for driving while intoxicated. A routine search of his phone by probation officers revealed images of child porn and social media conversations. A search of his home and devices by the FBI turned up approximately 81 images and 59 videos, including some depicting violence against children as young as five.
After pleading guilty, Herbst was sentenced to 36 months in prison.
Before reporting to prison, the 27-year-old is accused of uploading child porn to Snapchat. A new search warrant was executed by the FBI which revealed Herbst was trading child pornography using a prohibited device in violation of his release conditions.

If convicted, he faces 15-40 years in prison and a $250,000 fine.
