A 76-year-old Wayne County man has been charged with two counts of felony rape.
According to State Police, David Smith allegedly subjected a child under the age of 11 to sexual contact at his Town of Ontario home. Following his arraignment, Smith was sent to the Wayne County Jail in lieu of $50,000 bail.
An Order of Protection was requested on behalf of the victim.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
