Federal Judge Allows Cayuga Nation Lawsuit Against NY to Proceed

The Cayuga Nation has won a key ruling in its lawsuit against New York State over lottery ticket sales on nation property.

A federal judge with the U.S. District Court for the Northern District of New York has denied the state Gaming Commission’s motion to dismiss the case, allowing the nation to move forward with its claims. The lawsuit alleges that the state is illegally operating Class III gaming, including lottery vending machines,  on the nation’s federally recognized reservation without consent or a federally approved gaming compact.

The nation says the July 30 decision is an important step toward ensuring that the Indian Gaming Regulatory Act is enforced on its lands.
