UPDATE: Jury Reaches Verdicts for Three Suspects Accused of Marcy Inmate’s Death

12 p.m. UPDATE: A jury on Monday acquitted two former correction officers in connection with the beating death of Marcy Correctional Facility inmate Robert Brooks.

Matthew Galliher and Nicholas Kieffer are now cleared of all criminal charges.

A third officer, David Kingsley, was convicted of murder and manslaughter and now faces a potential life sentence. His sentencing is expected to take place by the end of the year.

Jury deliberations are set to resume Monday in Oneida County in the trial of three former Marcy Correctional Facility officers accused in the death of inmate Robert Brooks.

The defendants—David Kingsley, Matthew Galliher, and Nicholas Kieffer—have maintained through their attorneys that they played minor roles, if any, in Brooks’ death. The jury has been deliberating since last Wednesday afternoon.

Prosecutors allege that body camera footage shows multiple officers punching, kicking, and grabbing Brooks by the neck on December 9, 2024, the day he was transferred from Mohawk Correctional Facility to Marcy. Brooks, 43, of Rochester, died the following day. He had been serving a 12-year sentence for assault in a stabbing case involving his girlfriend, with a scheduled release in 2026.

A separate development in the case saw former Marcy corrections officer Christopher Walrath sentenced Monday in Oneida County Court to 15 years in prison after pleading guilty to first-degree manslaughter on May 5.

A total of 10 correctional officers have been charged in connection with Brooks’ death.
