New York State’s Division of Consumer Protection is urging the federal government to investigate—and potentially recall—a children’s toy after state testing found dangerously high levels of lead in its paint.
The toy, “Truck & Car Set: 2 Vehicles with Trailer,” sold at Dollar General stores across New York and distributed by Old East Main Co., was found to contain inconsistent but significant lead levels in its red and gray surface coatings. In some samples, lead content reached up to 11 times the federal limit set under the Consumer Product Safety Improvement Act (CPSIA).
State testing found:
- Up to 1,000 ppm of lead in red paint on the toys’ taillights
- 240 ppm of lead in gray paint on the truck’s front
Federal law caps allowable lead in paints and surface coatings at 90 ppm.
The Division of Consumer Protection (DCP) has asked the U.S. Consumer Product Safety Commission (CPSC) to launch a national investigation and recall. CPSC has opened a case, and Dollar General has removed the toys from New York stores pending further testing. DCP also contacted the distributor, requesting that it halt distribution statewide and nationwide.
State officials are warning parents and caregivers about the potential risk to children, especially ahead of the holiday season.
“It is deeply concerning and disappointing to learn that some of the products intended for our children fail to meet the health and safety standards they deserve,” said Secretary of State Walter T. Mosley. He urged federal officials to act before more families unknowingly purchase the toy.
State Health Commissioner Dr. James McDonald echoed the warning, noting that toys with lead paint pose particular danger to young children, who may put the items in their mouths. “Products that are found to violate established health and safety standards should be removed from store shelves and a recall should be issued,” he said.
What Consumers Should Do
Families who own the toy have several options:
- Dispose of it safely by placing it in household garbage.
- Hold onto it in a secure spot while awaiting possible recall instructions.
- Seek a refund or store credit from Dollar General if the toy is unopened, in accordance with store policies.
Why Lead Exposure Is Dangerous
Lead is sometimes found in paint, toys, jewelry, cosmetics, and other consumer products. According to the New York State Department of Health, lead exposure can harm a child’s growth, behavior, learning ability, kidneys, and hearing. The levels found in the Truck & Car Set pose a significant health concern.
