New York Cannabis Packaging and Marketing Regulations Take Effect

The New York State Office of Cannabis Management announced that updated Packaging, Labeling, Marketing, and Advertising regulations are now officially in effect after being published in the State Register. The changes were approved by the Cannabis Control Board at its most recent meeting.

State officials say the revised rules are designed to provide greater clarity and flexibility for licensed cannabis businesses while maintaining consumer protections. The updates include expanded marketing options, clearer signage standards, and authorization for rewards and loyalty programs. Several changes to packaging and labeling requirements will include a six-month transition period to allow licensees time to come into compliance.

“This regulatory package delivers what licensees have asked for: clearer rules, more flexibility, and a more consistent framework across the supply chain,” said Cannabis Control Board Chair Jessica Garcia. “By improving marketing options and resolving long-standing ambiguities, we are giving operators a stronger foundation to succeed while ensuring regulations remain protective and transparent.”

Among the key changes are clarified rules for outdoor signage, including the removal of the previous two-sign limit, clearer guidelines for promotions and discounts, updated advertising audience thresholds, and modernized packaging and labeling standards.

The regulations also reaffirm that billboard advertising remains prohibited under state law. Licensees currently using billboards or other prohibited signage have until February 24, 2026, to remove them before enforcement action may be taken.

Most provisions are effective immediately. Packaging-related requirements, including retail packaging standards, exit packaging, warning statements, and required labeling elements, will take effect six months from the publication date.

State officials say the updates reflect public feedback collected over the past two years and are intended to support a safe, transparent, and well-regulated cannabis market while fostering growth among licensed businesses.
