Four Marcy Correctional Officers Accept Pleas in Inmate Death Case

Four former Marcy Correctional Facility officers are awaiting sentencing after accepting plea deals in connection with the death of Robert Brooks, of Rochester, who died on December 10, one day after being beaten by officers at the state prison.

Nicholas Anzalone, 44, and Anthony Farina, 49, pleaded guilty Monday to first-degree manslaughter. Both were originally charged with murder and admitted their assault on Brooks caused his death. They face up to 22 years in prison.

Michael Mashaw, 48, and David Walters, 37, also accepted plea deals, admitting to neglecting their duty to intervene during the assault. Walters additionally admitted he instructed a nurse not to enter the room where the beating occurred. Mashaw will be sentenced to three to nine years, and Walters to two and one-third to seven years. Sentencing for all four is scheduled for Nov. 21.

Three other officers, David Kingsley, Matthew Galliher, and Nicholas Kieffer, charged with murder, and Michael Fisher, charged with manslaughter, rejected plea deals and are set to go to trial in early October. Kingsley, Galliher, and Kieffer face 25 years to life if convicted; Fisher faces five to 15 years.

Two additional officers, Nicholas Gentile and Christopher Walrath, previously reached guilty pleas in the case.
