Victory Man Arrested for Strangling Family Member

Victory police say a 26-year-old man was arrested last week following a domestic incident that left a family member injured.

Erik Johnston, of Victory, was taken into custody Jan. 18 after deputies responded to a reported domestic dispute on Route 104 around 10:15 p.m. According to Cayuga County Sheriff Brian Schenck, Johnston met deputies in a combative manner and continued to resist detention.

Investigators say the incident began as a verbal argument between Johnston and a female family member, which escalated when he allegedly placed his hands around her neck. The victim declined medical treatment.

Johnston was charged with second-degree strangulation, a felony; second-degree obstructing governmental administration, a misdemeanor; and resisting arrest, a misdemeanor. He was processed at the Public Safety Building and later arraigned in Cayuga County Jail. Johnston appeared in Victory Town Court on January 21.

He remains in custody at the Cayuga County Jail.

The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
