A Texas man is facing charges of DWI following a traffic stop in the village of Penn Yan.
Daniel Hernandez was stopped by Penn Yan Police after they allegedly spotted the vehicle he was driving speeding on both Liberty and Lake streets early Saturday morning. Police say they also witnessed the car being operated erratically in inclement conditions.
During the traffic stop, officers said they observed Hernandez display several indicators of intoxication. The Edinburg, Texas, man was placed through a series of field sobriety tests, which he failed.
Hernandez was taken to the Yates County Public Safety Building where he voluntarily submitted to a chemical breath test which revealed his blood alcohol content to be .16%.
Hernandez was charged with DWI, DWI (.08% BAC or greater), consumption of alcohol in a motor vehicle, speeding amd speed not reasonable and prudent. He was released to appear in Penn Yan Village Court at a later date.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
