A Syracuse man was charged with driving while intoxicated after being involved in an accident in the area of Route 31 and Mills Road in the town of Mentz.
As the Cayuga County Sheriff’s Office arrived on scene, deputies observed a car off the road in the ditch. The sole occupant of the car, 42-year-old Brian Ellsworth, showed signs of being intoxicated.
In addition to DWI, Ellsworth was charged with aggravated DWI with a BAC above .18% and other traffic infractions.
Ellsworth was released on appearance tickets for Mentz Town Court.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
