Summerhill Man Arrested After Repeated Violations of Order of Protection

A Cayuga County man is behind bars after repeatedly violating an order of protection and evading law enforcement for nearly two months, according to Sheriff Brian Schenck.

Justin Kellogg was arrested on Saturday by members of the Cayuga County Sheriff’s Office. Deputies had been searching for Kellogg in connection with multiple alleged violations of a court-issued stay-away order. He was wanted on two arrest warrants from the Town of Summerhill—one for first-degree criminal contempt (a class E felony), and another for second-degree criminal contempt (a misdemeanor), along with an aggravated family offense charge (also a class E felony).

The charges stem from two separate incidents in May. On May 15, deputies responded to a report that the 39-year-old Kellogg had sent threatening text messages to the protected party named in a full stay-away order. Despite being previously informed of the order’s terms by the court, Kellogg continued to make contact and refused to cooperate with deputies. That resulted in the first warrant.

A second incident occurred on May 18, when deputies were again called to the same Summerhill address after Kellogg allegedly continued contacting the protected party. A second warrant was issued for criminal contempt and aggravated family offense due to a prior domestic-related conviction.

On Saturday, deputies received a tip that Kellogg was at the same residence he had been ordered to stay away from. He was found hiding in a garage and initially refused to surrender, but complied after deputies warned that K9 Pitt would be deployed.

Kellogg was taken into custody and charged with additional counts of second-degree criminal contempt and aggravated family offense. He was processed and held at the Cayuga County Jail.

He was arraigned in CAP Court and jailed without bail.

The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
