A Cayuga County man is facing felony charges after allegedly driving a homemade motorized scooter while intoxicated, then being found lying in the roadway, according to the Cayuga County Sheriff’s Office.
Sheriff Brian Schenck reported that deputies arrested 54-year-old Charles Newkirk, of Sterling, on the evening of June 14. Newkirk is charged with Driving While Intoxicated – Previous Conviction within 10 years (a Class E felony) and Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree (also a Class E felony).
Authorities were called around 6:40 p.m. after receiving a report of an intoxicated man driving a motorized scooter and later seen lying in the road. Deputies responded to the scene and determined that Newkirk had been operating a homemade scooter equipped with a gasoline-powered motor while under the influence of alcohol.
Newkirk was taken into custody and transported to the Cayuga County Public Safety Building for processing. He was later taken to the Cayuga County Jail for arraignment in CAP Court.
He is scheduled to appear in Sterling Town Court at a later date.
The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
