The investigation into the report of a disorderly male inside the Circle-K on Fall Street in Seneca Falls resulted in the felony arrest of a Seneca Falls man.
During an interview with police, officers said it was apparent that Wayne Smith was under the influence of alcohol and had also allegedly driven his car to the convenience store prior to their arrival. Smith was ultimately charged with two separate DWI charges due to this being his third DWI arrest within the previous ten years. Smith has two prior DWI convictions. Both charges following the Monday morning incident were felonies.
Smith was released on an appearance ticket for the Seneca Falls Town Court.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
