A traffic stop in the village of Penn Yan resulted in the arrest of a Rochester man on DWI charges.
Brandon Harding was stopped by Penn Yan Police after allegedly committing traffic violations. While speaking with Harding, police say the 39-year-old showed signs of impairment. He was placed through standard field sobriety tests, which he failed. Harding was taken into custody and transported to the Yates County Jail for a chemical test. According to Penn Yan Police, the chemical test Harding provided resulted in a .22% BAC.
Harding was charged with Aggravated DWI, DWI of .08% or greater, DWI, Improper U-Turn and an Unsafe Lane Change. He will appear in Penn Yan Village Court at a later date to answer the charges.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
