A Phelps man is being held at the Ontario County Jail after deputies say he was arrested on an active bench warrant.
Authorities report that 35-year-old Kenneth Carl Niles was taken into custody without incident on Monday at the jail. The warrant was issued by Ontario County Court Judge Reston after Niles allegedly failed to appear in court on charges of driving while intoxicated and aggravated unlicensed operation.
Niles remains in custody and is expected to be arraigned to answer the charge.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
