The investigation into the report of a driver parked on the side of Pre-Emption Road in the town of Benton Sunday night resulted in the arrest of a Penn Yan woman.
When deputies approached the vehicle, they found its driver, 42-year-old Kristen Schuck, asleep in the driver’s seat. Schuck allegedly showed signs of intoxication and was subsequently arrested for drunken driving.
Schuck was also charged with DWI Common Law, Aggravated DWI .18% BAC or greater, consumption of an alcoholic beverage in a car, and other traffic and vehicle violations.
Schuck was transported to the Yates County Public Safety Building for a chemical test and was released on tickets to appear in Benton Town Court at a later date.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
