A traffic stop in the village of Penn Yan resulted in the arrest of a Penn Yan man on a felony DWI charge.
Penn Yan Police observed Brian McGann driving a car on Lake Street with a passenger side tail lamp out. A traffic stop was initiated and contact was made with McGann who exhibited several signs of intoxication. The 70-year-old McGann was placed through a series of field sobriety tests, which police said he failed. He was then taken to Soldiers and Sailors Memorial Hospital where he voluntarily submitted to a blood draw to determine his blood alcohol content. A DMV check of his license revealed McGann had a previous DWI conviction within the previous ten years making this DWI arrest a felony.
McGann will answer the charge in Penn Yan Village Court at a later date.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
