Penn Yan police say a local man was arrested last week for criminal contempt following a disruptive incident in Village Court.
Officers report that 45-year-old Brian Swinehart of Penn Yan appeared in court on an unrelated charge but behaved in a manner that interfered with court proceedings. Police say Swinehart was insolent and disruptive in front of the Village Justice, the Yates County District Attorney, and other court observers.
At the judge’s order, Swinehart was removed from the courtroom. He was then taken to the Penn Yan Police Department, where he reportedly continued the disruptive behavior.
Swinehart was released on an appearance ticket and is scheduled to appear in Penn Yan Village Court at a later date.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
