A traffic stop on Liberty Street in the village of Penn Yan resulted in the arrest of an Ontario man.
Spencer McSain was stopped after police observed the car he was driving to have an expired inspection. During the traffic stop, the 33-year-old displayed indicators of intoxication, according to police. McSain was placed through a series of standardized field sobriety tests, which he failed.
McSain was taken into custody and transported to the Yates County Jail where he voluntarily submitted to a chemical breath test which revealed his blood alcohol content to be 0.05%.
McSain was charged with driving while ability impaired by alcohol and driving an uninspected motor vehicle.
McSain was issued traffic tickets to return to the Penn Yan Village Court at a later date to answer to the charges.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
