Seneca County Sheriff Brian Schenck reports that 25-year-old Gage Benson of Niles was arrested on December 7 after deputies found him driving under the influence following a motor vehicle accident in the Town of Locke.
Deputies responded around 6:30 p.m. to State Route 38 after Benson called 911, reporting he had struck a deer. During the investigation, officers determined Benson was intoxicated. A chemical breath test later showed a blood alcohol content of .17%.
Benson was charged with first-offense DWI, DWI with a BAC of .08% or higher, driving without New York State inspections, and having an open container. He was processed, issued traffic tickets, and is scheduled to appear in Locke Town Court on December 17 at 7 p.m.
The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
