A Branchport man arrested last week for allegedly subjecting a person in the village of Penn Yan to unwanted sexual contact while they held the person on the ground and choked them all in the presence of a child is facing a new charge.
Preston Brown is now charged with felony criminal sexual act.
Brown was originally charged with sexual misconduct, unlawful imprisonment, criminal obstruction of breathing, forcible touching and harassment. One day after the alleged incident occurred, According to Penn Yan Police, Brown was arrested again after he was accused of violating an order of protection that was put into place.
