A Naples man will appear in Penn Yan Village Court to answer charges following a traffic stop in the Yates County village.
Sean McClain was stopped after officers observed him to be driving a car with no tail lights on Elm Street. Upon making contact with McClain, multiple open containers of alcohol were found inside the car, as well as McClain exhibited several signs of intoxication. McClain was placed through a series of field sobriety tests, which police say he failed.
McClain was brought to the Yates County Jail where he voluntarily submitted to a breath test, which revealed his blood alcohol content to be 0.18%.
McClain was charged with Driving While Intoxicated, Aggravated DWI, Driving with .08% or more of alcohol, Aggravated Unlicensed Operation of a Motor Vehicle, and Inadequate Tail Lights.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
