A Naples man was arrested by the Penn Yan Police Department following a traffic stop on North Avenue in the village.
Police received a complaint of a possible intoxicated driver traveling towards the village on Route 54. Officers soon located the car and conducted a traffic stop and observed violations of New York State Vehicle and Traffic Law. During the stop, police say they observed the driver, Jerry Busby, display several indicators of intoxication being bloodshot and watery eyes, slurred speech and the odor of an alcoholic beverage. Busby was placed through standardized field sobriety tests, which he failed. He was then placed under arrest and taken to Soldiers and Sailors Hospital where he voluntarily submitted to a blood draw to determine his blood alcohol content.
Busby was charged with driving while intoxicated, driver’s view obstructed, and no headlamps in inclement weather. He will answer the charges in Penn Yan Village Court at a later date.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
