The investigation into a hit-and-run car crash at a business in the village of Penn Yan resulted in the arrest of a Rochester man.
A witness to the collision advised Penn Yan Police of the vehicle’s description and direction of travel, and officers were soon able to locate the car and its driver in the parking lot of a second Penn Yan business. During their investigation, police reported that they observed Foley show several signs of intoxication and found him to be in possession of an open container of alcohol in the car. Foley was placed through a series of standardized field sobriety tests, which he failed.
Foley was placed under arrest and transported to the Yates County Jail for a chemical breath test, which he refused.
Foley was released on an appearance ticket for Penn Yan Village Court.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
