A Himrod man has a date in Penn Yan Village Court after leading police on a pursuit.
Officers with the Penn Yan Police Department said they observed 25-year-old Kalob Murphy stop abruptly at Liberty and Elm streets in the village of Penn Yan almost striking another car. As Murphy continued south on Liberty Street, he was clocked by police to be driving 76 miles per hour in a 30 miles per hour zone. After officers activated their emergency lights, they reported Murphy was swerving within his lane. When the pursuit reached the village limits of State Route 14A, Murphy reportedly drove off the road while passing another car and entered a field. He attempted to re-enter the road but his car became stuck.
Murphy, who displayed several signs of impairment to police, was placed through standardized field sobriety tests, which he failed. A chemical breath test at the Yates County Jail revealed his blood alcohol content to be .18%.
Murphy was charged with driving while intoxicated, aggravated driving while intoxicated, reckless driving, unlawful fleeing, and speeding.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
