A Geneva man was found to be nearly four times the legal limit for alcohol when he crashed his vehicle Sunday evening in the Exchange Place parking lot, according to city police.
Officers responded around 7:00 p.m. to the scene of a two-vehicle crash and identified Nicholas Aliva-Marfinez as one of the drivers. Police say he showed signs of intoxication and failed field sobriety tests.
A chemical test later revealed a blood alcohol content of .28% — more than three and a half times New York’s legal limit of .08%.
Aliva-Marfinez was taken to the Geneva Police Department, processed, and released to a third party. He was issued an appearance ticket and is due in court at a later date to answer to DWI charges.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
