Geneva Man Arrested on DWI Charge in Penn Yan

A Geneva man was arrested in Penn Yan after police say he was found asleep at the wheel of a running vehicle in a municipal parking lot.

According to Penn Yan Police, officers responded to a report of a suspicious vehicle and found 27-year-old Jacob Diehm inside with the engine running and driver’s side door open. Police said Diehm was asleep at the wheel with the lights on, and officers also observed vomit and feces on the pavement beside the car.

After being awakened by officers, Diehm identified himself with his New York driver’s license. Police said he showed several signs of intoxication and failed field sobriety tests. He was taken into custody and transported to the Yates County Jail, where a breath test showed a blood alcohol content of 0.12%.

Diehm was charged with DWI, DWI with a BAC of 0.08% or greater, and disorderly conduct. He was processed and released with tickets to appear in Penn Yan Village Court at a later date.

The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
