A Farmington man is facing multiple felony charges following a reported sexual assault involving a minor in Penn Yan.
Penn Yan Police said 34-year-old Daniel Sims was arrested after officers received a report of a sexual assault involving a 15-year-old victim. Investigators allege Sims provided the victim with alcohol and drugs and then engaged in vaginal and oral sexual contact while the victim was under the influence and incapacitated.
Authorities said Sims was on parole at the time of the incident. He was taken into custody by New York State Parole officers and later turned over to Penn Yan Police.
Sims has been charged with Rape in the First Degree, a class B felony; Rape in the Third Degree, a class E felony; and Facilitating a Sexual Performance of a Child with Drugs or Alcohol, a class B felony.
He was transported to the Yates County Jail, where he is being held pending arraignment in Yates County CAP Court.
Penn Yan Police said the investigation was assisted by the Child Advocacy Center of the Finger Lakes, the Yates County District Attorney’s Office, and the New York State Department of Corrections and Community Supervision.
The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
