A one-car accident in the village of Penn Yan resulted in the arrest of the driver on DWI charges.
Sirino Martinez, of Penn Yan, was allegedly driving drunk when he lost control of his car and struck a tree on Franklin Street. The 55-year-old refused to perform sobriety and chemical analysis tests and was charged with driving while intoxicated, moving from lane unsafely, and consuming alcohol in a motor vehicle.
Martinez will be back in Penn Yan Village Court at a later date to answer the charges.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
