A Canandaigua man already behind bars is facing new charges after investigators say he violated an order of protection while incarcerated.
The Ontario County Sheriff’s Office says 45-year-old Justin Payne was charged Tuesday with criminal contempt in the first degree. Deputies allege Payne mailed letters to a protected party despite a full stay-away order being in place.
Payne, of Saltonstall Street, has a prior conviction for criminal contempt in the second degree and was also charged with first-degree criminal contempt on August 21.
He remains held at the Ontario County Jail awaiting arraignment.
The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
