A traffic stop Monday morning on State Route 332 at the Farmington-Canandaigua Townline Road in the town of Canandaigua resulted in the arrest of a Canandaigua man.
During the roadside investigation, it is alleged that Juan Garcia-Rivera was driving while being impaired by alcohol or drugs and was also in possession of two controlled substances. He refused to provide a blood/breath sample for toxicology.
Garcia-Rivera was charged with Driving While Ability Impaired by Drug, Driving While Ability Impaired by Drug/Alcohol Combo, Driving While Intoxicated-Common Law, moving from lane unsafely, driving too slow, improper left-hand turn, no license plate, and two counts of criminal possession of a controlled substance.
Garcia-Rivera was held at the Ontario County Jail pending CAP arraignment.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
