A Canandaigua man was arrested Monday night following a traffic stop on State Routes 5 and 20 in the town of Canandaigua for a sick or intoxicated driver.
According to the Ontario County Sheriff’s Office, during the roadside investigation, Kenneth Stellwegen exhibited indicators of intoxication and was subjected to a standardized field sobriety test. Deputies say those tests provided further indicators of intoxication. Following the investigation, Stellwegen was taken into custody without incident.
Stellwegen had a previous conviction for driving while intoxicated in 2015 making this incident a felony arrest for driving while intoxicated. The 46-year-old was taken to Ontario County Jail and held for pre-arraignment detention.
Stellwegen will return to the Canandaigua Town Court at a later date to answer the charge.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
