A Canandaigua man was arrested for swimming in a prohibited area near Kershaw Park and resisting arrest.
According to Canandaigua Police, officers confronted Houston Fontaine and informed him that he was under arrest for swimming in the restricted zone. Fontaine attempted to walk away, resisting efforts to take him into custody. During the arrest, he took an officer’s body-worn camera and threw it into the lake, damaging the device beyond repair.
Fontaine was charged with Swimming in a Prohibited Area, Resisting Arrest, Obstructing Governmental Administration, and Criminal Mischief in the Third Degree. He was released on an appearance ticket and is scheduled to appear in Canandaigua City Court at a later date.
The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
