Branchport Woman Arrested for Falsely Reporting an Incident

Following a complaint for a welfare check request, a Branchport woman was arrested by Penn Yan Police.

The complainant told officers that Joanna Rutherford allegedly refused to leave a business in the village and they would like her removed. While attempting to speak with officers, she reportedly started to yell and act in a disorderly manner. Officers advised the 40-year-old to stop, which she refused. Rutherford then allegedly proceeded to call 911 for no legitimate purpose.

After being taken into custody, Rutherford resisted and refused to get into the patrol car. She was eventually taken to the police department for processing on charges of falsely reporting an incident, resisting arrest, disorderly conduct and open container.

Rutherford was released on an appearance ticket for Penn Yan Village Court.

The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
