A Bath man is now in police custody on felony charges after he was spotted by police walking on State Route 415.
Officers knew Zachariah Cole had pending charges out of the Bath Police Department that the officers who spotted him knew about. The felony charges of criminal trespass and criminal possession of a controlled substance stem from two different incidents.
On June 27th, the Bath Police Department received a report of a man who had entered a condemned apartment, to which he was not lawfully allowed. After an investigation, the man in question was identified as Cole.
On July 3rd, Cole was taken into custody on his criminal trespass charge. A subsequent search was conducted, and Cole was allegedly found to be in possession of a quantity of Buprenorphine Hydrochloride pills and sublingual films. It was determined that Cole did not have a valid prescription for this drug and did intend to sell it to another person.
Cole was brought to the Steuben County Jail for arraignment. He was released as the charges do not qualify for bail and will return to Bath Village Court at a later date.
The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
