Auburn Authorities Arrest Man on Felony Criminal Contempt Charge

Auburn Police made a felony arrest on Monday after learning of an incident involving two former intimate partners at a location in the town of Owasco.

It is alleged that Mitchell Podolak has just approached the unidentified partner to drop off children at the undisclosed location. During this custody exchange, it is alleged that Podolak became agitated and the encounter with the victim escalated to where the suspect attempted to strike the woman in the presence of the children. Police report Podolak’s actions caused the victim to fear for her safety. The woman was a protected party in a previously issued and duly served order of protection.

At the time of this incident, Podolak was released from charges stemming from a separate domestic incident that took place the day before.

In a joint effort with the Cayuga County Sheriff’s Office, Auburn Police took Podolak was taken into custody without incident. He was charged with felony criminal contempt, two counts of misdemeanor endangering the welfare of a child, and harassment, a violation

Podolak was held at the Cayuga County Jail in lieu of bail.

The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
