An Avoca man faces charges after a one-car accident on Norris Road in Himrod.
According to the Yates County Sheriff’s Office, Justin Bauter was unable to negotiate a curve and ended up on the Norfolk Southern train tracks. Upon further investigation, Bauter had an odor of an alcoholic beverage and was placed through a series of standardized field sobriety tests.
Bauter was charged with Common Law DWI, DWI BAC over 0.08%, speeding and an unsafe lane change. He will appear in Milo Town Court at a later date to answer the charges.
