Deputies were called to a family disturbance Saturday in the Town of Lyons after reports that a mother was attempting to take a child, prompting another man to draw a firearm. Upon arrival, deputies detained one man and recovered a small handgun from the vehicle involved.
David Tulley of Lyons allegedly attempted to stop a vehicle from leaving by trying to enter it and punching its windows. At the time, two adults and two children were inside. According to authorities, the male in the vehicle drew the gun to defend himself and the children from Tulley.
While deputies were still on the scene, Tulley reportedly attempted again to enter the driver’s side of the vehicle, further escalating the situation. He was then informed he was under arrest, after which he attempted to flee into his residence and tried to slam the door on deputies.
Tulley was arrested and charged with endangering the welfare of a child under 17, obstructing governmental administration in the second degree, and resisting arrest.
He was transported to the Wayne County Jail for arraignment. The Wayne County Sheriff’s Office was assisted by the New York State Police during the investigation.
The fact that a defendant has been charged with a crime is merely an accusation; the defendant is presumed innocent until and unless proven guilty.
