In Ontario County, a sheriff’s deputy is taking legal action against the county’s District Attorney. Deputy Brian Larkin has filed a lawsuit against District Attorney James Ritts, alleging that Ritts is sending letters to defense attorneys that claim Larkin wrote inaccurate reports in two separate incidents.
The Daily Record reports these letters are intended to disclose potential evidence that could impact a criminal case. According to the lawsuit, Ritts has been sending these letters in every case involving Larkin, accusing him of filing reports that differ significantly from bodycam footage. Larkin’s attorney argues that these accusations were already found to be false by an arbitrator earlier this year.
The Record reports the lawsuit also claims Ontario County Sheriff David Cirencione has refused to let Larkin maintain his certification as a drug recognition expert and evidence technician, which has had a financial impact on Larkin.
Larkin claims that DA Ritts has violated his constitutional rights by not allowing him to challenge the allegations. He is seeking a court order to stop Ritts from sending these letters to defense attorneys.
