A former Seneca County Sheriff’s deputy who resigned last year amid allegations he drove a patrol vehicle while under the influence is now facing a new driving while intoxicated charge.
Johnathan McNabb of Seneca Falls was stopped by police this week in Ovid after reportedly failing to maintain his lane. Following a roadside investigation, officers charged the 33-year-old with misdemeanor DWI and cited him for failure to keep right.
McNabb stepped down from the Sheriff’s Office last May after being accused of operating his patrol car while impaired. In that case, he submitted to a breath test that registered a blood-alcohol content of 0.10 percent. Sheriff Tim Thompson said there was initially no indication that McNabb had consumed alcohol, and the Seneca County District Attorney later determined there was insufficient evidence to file a DWI charge related to that incident.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
