A state appeals court has denied a resentencing request for a Cayuga County woman serving time for the 2012 murder of her boyfriend.
The Appellate Division, Fourth Department of the New York State Supreme Court, upheld the original sentence of 21 years to life for Brenda Newkirk, who pleaded guilty to second-degree murder in May 2013.
Newkirk fatally shot her boyfriend, Henry Davis Jr., five times in their Conquest home. In her resentencing motion, her attorney argued the sentence should be reduced, citing claims that Newkirk had allegedly been a victim of domestic violence.
Both the Cayuga County Court and the appeals court rejected that argument. Newkirk’s conviction was previously upheld by the appellate court in 2016.
