A not guilty plea from the Port Byron woman charged in connection with a car crash last November in Onondaga County that killed an Auburn resident.
21-year-old Kaitlyn Kudla was allegedly under the influence of alcohol when she lost control of her car on West Seneca Turnpike in Onondaga on November 3rd. A passenger, 22-year-old Riley Besner, died ten days following the crash from injuries he suffered in the accident.
The Citizen reports Kudla was offered a plea deal of ten years in state prison for the felony aggravated vehicular homicide charge, but turned it down. She is also charged with:
- PL 125.12 (Class D Felony) – Vehicular Manslaughter in the Second Degree
- PL 120.05 (Class D Felony) – Assault: Recklessly Causing Serious Injury with a Weapon (Motor Vehicle)
- VTL 1192.2 (Unclassified Misdemeanor) – Operating a Motor Vehicle with a BAC of .08% or Higher (First Offense)
- VTL 1212 (Unclassified Misdemeanor) – Reckless Driving
- VTL 1128(a) (Infraction) – Moving from Lane Unsafely
Kudla is due back in court.
The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty.
